Tripwise Terms and Conditions

These Terms and Conditions (“Terms”) outline the legally binding agreement between you and us when you access our Website or use our Services. By engaging with the Website or Services, you confirm that you understand and accept these Terms as legally binding. Throughout these Terms, “we,” “us,” and “our” refer to Tripwise Company, a registered entity in India. The terms “you” and “your” apply to any individual accessing or utilizing the Services. All bookings made through our Website, with our employees over the phone, via email, or through any other form of communication are subject to these Terms. If a booking is made on behalf of multiple travellers, the person initiating the booking is deemed to have the authority to accept these Terms on behalf of all other travellers.

1. Definitions

1.1 The headings included in these Terms are solely for reference and organizational purposes. They do not influence or aid in the interpretation of the clauses to which they correspond.

1.2 Unless explicitly stated otherwise or if the context indicates a different intention, references to any gender shall be considered to encompass all genders. Similarly, words used in the singular form shall include the plural, and vice versa. Furthermore, references to natural persons shall be understood to include legal entities, organizations, and corporations, and vice versa.

1.3 The following definitions apply to terms used in these Terms:

  • Accommodation Provider: Refers to any entity or provider responsible for offering lodging, which may include, but is not limited to, hotels, private homes, rental properties, or any other form of accommodation.
  • Activity Provider: Denotes an individual, company, or organization that offers or facilitates experiences, tours, excursions, or any recreational or cultural activities.
  • Additional Services: Encompasses any supplementary services associated with a Booking that are provided by a Service Provider. These services may include, but are not limited to, baggage upgrades, priority boarding, in-flight meals, minibar usage, dry cleaning and laundry, rebooking or cancellation services, passenger information amendments, and other incidental costs. The fees for these services are determined by the respective Service Provider or a third party and are not included in the Total Price unless explicitly added during the Booking process. If such Additional Services are requested after completing a Booking, the responsibility for arranging them rests solely with the user, who must directly contact the relevant Service Provider or third party.
  • Booking: Represents the act of selecting and purchasing one or more travel-related services, such as flights, accommodations, or activities. A Booking is deemed complete once confirmation is received that full payment for the Total Price has been successfully processed and accepted.
  • Carrier: Defines the airline or aviation service responsible for providing transportation via air travel. At the time of Booking, the identity of the Carrier, including details of any connecting flights, will be disclosed. However, due to unforeseen circumstances, the actual Carrier operating a flight may differ from the one initially stated. It is the responsibility of the traveller to verify the identity of the operating Carrier before departure.
  • Service Provider: Encompasses all entities responsible for delivering the travel-related services included in a Booking. This may include Carriers, Accommodation Providers, and Activity Providers. In cases where a Booking involves multiple Service Providers, each provider is treated as an independent entity responsible only for their respective portion of the services.
  • Services: Refers to the Booking services made available through the Website, enabling users to purchase Travel Products. Further details regarding the Services offered can be found in Section 2 of these Terms.
  • Total Price: Represents the final amount payable by the user at the point of confirming a Booking. This price includes the cost of any selected Travel Products, as well as any Additional Services chosen during the Booking process, such as extra baggage, premium seating, or in-flight meals.
  • Travel Document: Denotes any physical or digital confirmation document issued as proof of a contract established on behalf of the user with a Service Provider. Travel Documents may include, but are not limited to, airline tickets, hotel booking vouchers, and activity confirmations.
  • Travel Product: Covers all travel-related products available for purchase through the Website. These may include accommodation, flights, tours, activities, and any Additional Services that are selected and purchased during the Booking process.
  • Tripwise Account: Refers to the registered user account required to access and utilize the Website’s functionalities, including managing Bookings and payments.
  • Tripwise Wallet: Represents the digital wallet linked to a user’s Tripwise Account, used to store funds deposited by the user or funds acquired through refunds, credits, or promotions.
  • Website: Refers to the official Tripwise website, including all its associated subdomains and digital platforms used to facilitate Bookings and provide Services.

2. Services

2.1 This section outlines the contractual relationship between you and us, under which we provide Services related to the Travel Products that you purchase in exchange for the Total Price. The Services that we offer include:

  • Presenting detailed information, availability, and pricing for Travel Products on the Website;
  • Enabling you to complete a Booking and purchase Travel Products through the functionalities provided on the Website for the applicable Total Price;
  • Facilitating the contractual arrangement between you and the relevant Service Provider; and
  • Issuing and delivering Travel Documents that confirm your Booking.

2.2 By finalizing and submitting an order on the Website in relation to your Booking, you acknowledge and agree to be legally bound by these Terms. When we accept and confirm the receipt of your payment, the contractual relationship between you and us is established. If your Booking is made through any means other than the Website—such as when one of our employees processes the order on your behalf following communication via email or other methods—these Terms will apply based on your explicit and legally binding offer to complete the Booking after we have provided you with all necessary details regarding your reservation.

2.3 By purchasing a Booking, you confirm and represent that you have the legal authority to enter into and comply with these Terms. Additionally, you confirm that you have carefully reviewed and understood the terms and conditions, along with any other applicable policies, of the respective Service Provider(s) associated with your Booking.

2.4 You acknowledge that all information provided during the Booking process is accurate and up to date. We disclaim any responsibility for incorrect information submitted by you, except in cases where errors or inaccuracies result directly from our negligence. It is solely your responsibility to ensure that all details you submit—such as passenger names, travel dates, departure locations, and destinations—are correct. Furthermore, you must verify that any Travel Documents received from us accurately reflect your intended Booking.

2.5 If you wish to avail yourself of benefits linked to a frequent flyer program when booking a flight with a Carrier, it is solely your responsibility to provide your frequent flyer number. You must submit this information either within the appropriate section of the Booking form on the Website during the purchase process or by reaching out to us through correspondence before your departure. Please be aware that under no circumstances shall we be held responsible for any missed opportunities related to frequent flyer benefits.

2.6 These Terms operate independently from any other agreements, contracts, or policies established between you and the Service Provider(s) or any third-party entity responsible for fulfilling the Travel Product. By proceeding with a Booking, you recognize that these separate legal relationships exist and that our role is limited to providing the Services as described in this section.

2.7 We reserve the right to modify or withdraw any Travel Products listed on the Website without prior notice. This includes instances where a Service Provider changes or removes their offering, as well as cases of technical errors, misquotations, or human mistakes. Any such updates will be reflected on the Website to ensure that the information, availability, and pricing of Travel Products remain as accurate as possible. It is important to note that, on occasion, the price of a Travel Product may change between the time you select the item and the moment you attempt to finalize your Booking. If such a pricing adjustment occurs, we will make reasonable efforts to inform you before the purchase is completed. However, we are not obligated to issue refunds, reimbursements, or any form of compensation in situations where the price of a Travel Product is reduced after you have successfully completed your Booking.

3. Tripwise Account

3.1 To access certain features of the Services, including successfully completing a Booking, you must create a Tripwise Account. During the registration process, you are required to provide specific personal details that allow us to set up and maintain your Tripwise Account. You acknowledge that it is solely your responsibility to keep your Tripwise Account credentials, including your password, secure and confidential. Any actions taken through your Tripwise Account, including Bookings made under your credentials, will be considered as your responsibility. If you suspect or become aware of any unauthorized access to or misuse of your Tripwise Account, you agree to notify us immediately to prevent further security breaches.

3.2 We reserve the right, at our sole discretion, to restrict, suspend, or permanently terminate your access to your Tripwise Account or any part of the Services at any time, without prior notice or liability. This action may be taken for any reason we deem appropriate, including but not limited to security concerns, suspected fraudulent activity, or violations of these Terms. A suspension or termination of your Tripwise Account may prevent you from accessing your profile, previous Bookings, or other related Services, either temporarily or permanently.

3.3 You have the option to voluntarily close your Tripwise Account at any time. By choosing to terminate your account, you acknowledge that you will no longer have access to any of the Services provided through your Tripwise Account, including past or future Bookings. Once your Tripwise Account is deactivated, any associated data or stored information may no longer be accessible.

4. Travel Requirements

4.1 Our team may assist you by providing general guidance regarding passports, visas, and other necessary travel documents required for your trip. While we strive to offer helpful information, you acknowledge that this guidance is for informational purposes only and may not be comprehensive. It remains solely your responsibility to verify and obtain all required documentation before your departure. Any fines, penalties, delays, or additional costs resulting from failure to secure the appropriate travel documents will be your responsibility, except where our liability explicitly applies.

4.2 If you purchase a Booking for air travel with a Carrier, it is a fundamental requirement that you hold a valid passport. We assume that every individual included in the Booking possesses a valid passport. If any traveller within your Booking does not have a valid passport, it is imperative that you contact us immediately. Many countries enforce regulations requiring passports to remain valid for a minimum of six (6) months beyond the date of return, and some destinations may mandate the use of machine-readable passports. In addition to ensuring that all travellers possess valid passports, you are also responsible for obtaining any required visas, transit permits, or re-entry authorizations in accordance with immigration laws and regulations, including those for any countries you may pass through during transit.

4.3 If you have any specific travel-related needs, such as dietary preferences, seating preferences, accessibility requirements, or any other special requests, we encourage you to specify these at the time of Booking (if applicable). If the option is not available during the Booking process, you must contact us as soon as possible after completing your Booking to allow sufficient time for your request to be accommodated. While we will make every reasonable effort to facilitate your request, we cannot guarantee that the Service Provider will be able to fulfil it.

5. Travel Documents

5.1 Your Travel Document(s) will be sent to you electronically via the email address provided at the time of Booking. It is your sole responsibility to ensure that the email address you enter is accurate and up to date. If you realize that an error has been made in the email address provided, you must notify us immediately. We are not responsible for any delays or failures in the delivery of your Travel Document(s) if the issue arises due to an error on your part. Additionally, Service Providers or relevant authorities may require you to present various travel-related documents in either electronic or printed form, such as your itinerary, e-ticket(s), boarding pass(es), visa(s), passport, or other necessary identification.

5.2 Travel Documents may be subject to specific terms, conditions, or restrictions, including but not limited to being non-refundable, non-transferable, or incurring fees for modifications or cancellations. Upon receiving your Travel Document(s), you should carefully review them to ensure all details are accurate and in accordance with your Booking. If you have any questions or concerns, you should address them promptly to avoid complications with your travel plans.

5.3 All Travel Documents are strictly non-transferable. If you have purchased a flight through a Carrier, the Travel Document must be issued in the name of the passport or official photo ID holder. It is your responsibility to confirm that all personal details, including the name, date of birth, and document number of each traveller, are correctly recorded on your Booking. In the event of any discrepancies—such as an incorrect name, birth date, or other personal details—you must contact us immediately for assistance in rectifying the issue.

5.4 Ensuring compliance with health requirements and precautions related to your travel destination is entirely your responsibility. If you are traveling to a country that mandates proof of vaccination, you must obtain and carry the necessary vaccination documents. It is strongly recommended that you consult your general practitioner, travel clinic, or relevant medical authority before your departure to determine whether any vaccinations or medical precautions are required for your trip. Proper health preparations will help ensure a smooth and hassle-free travel experience.

6. Travel Insurance and Travel Advisory

6.1 Travel can sometimes involve unexpected events and disruptions. To safeguard yourself against unforeseen circumstances, it is strongly advised that you assess your need for travel insurance, particularly when planning international trips. A comprehensive travel insurance policy should ideally cover aspects such as medical expenses, personal injury, accidental death, loss of baggage, financial loss, trip cancellations, and personal liability. Please be aware that Tripwise does not sell travel insurance directly. However, we may be able to offer general guidance regarding travel insurance options. It is important to note that we are not liable for the general information we provide, nor are we responsible for any consequences arising from your decision to purchase or not purchase travel insurance.

6.2 Most countries provide official travel advisories that offer general and country-specific travel guidance. While we may assist by offering general information regarding travel conditions and advisories for specific destinations, we do not guarantee the accuracy, completeness, or reliability of such information. Consequently, we assume no liability for any losses, damages, or inconveniences that may result from reliance on this information. By completing a Booking, you confirm that your country of departure permits you to travel to your chosen destination. We bear no responsibility for any costs, penalties, or cancellation fees you may incur if you are unable to utilize your Booking due to travel restrictions, visa denials, or other unforeseen barriers that prevent your departure.

7. Payments

7.1 The price for your Booking is only confirmed once the Total Price has been paid in full. Please be aware that applicable taxes are subject to change, and the final tax amount will only be determined at the time your Travel Document is issued.

7.2 We accept payments through a variety of options, including select credit and debit cards, bank wire transfers, and other approved payment methods (collectively referred to as “Payment Method”).

7.3 Credit and Debit Cards
By agreeing to these Terms, you authorize us to process charges on your designated credit or debit card for any fees incurred in connection with the Services we provide. Please note that credit and debit card payments may be subject to an additional surcharge. The exact surcharge amount will be clearly displayed to you before completing your Booking. When making a Booking with a credit or debit card, you acknowledge that we are not responsible for any additional costs you may incur due to foreign exchange rates, bank charges, or card transaction fees. To clarify, Tripwise will not issue a refund for any fees related to these costs, whether incurred on your credit card, debit card, or Tripwise Wallet.

7.4 We reserve the right to delegate the processing and management of electronic payments, including transactions made via Visa, Mastercard, and American Express, to our subsidiaries or third-party payment service providers. Any fees associated with purchasing a Travel Product through us are non-refundable, except where required by applicable law.

7.5 By using our Services, you agree that our payment processors may securely store your payment details for future transactions related to your Booking, such as payments or refunds. When you submit your Booking, you grant us permission to facilitate reservations on your behalf, including handling necessary payments to Service Providers and third parties associated with fulfilling your Booking.

7.6 If you complete a payment online via our Website, you will not be required to make any additional payments directly to the Service Provider for the Travel Product specified in your Travel Document. However, in cases where your Booking involves a direct payment arrangement with a Service Provider (such as paying a hotel upon arrival), this distinction will be clearly indicated during the Booking process.

7.7 For Bookings arranged through a Tripwise employee, a deposit may be required. The required deposit amount and the number of deposits necessary for multiple Bookings will be communicated to you directly by a Tripwise representative. If you choose to modify or cancel your Booking, you acknowledge that your deposit(s) may be forfeited, subject to any rights you may have under applicable law. Since final payments for Bookings made with Service Providers may vary, we will notify you of the due date for the remaining balance.

7.8 In some cases, Tripwise may, at its sole discretion, offer you the option to secure certain Bookings with Accommodation Providers through a low deposit arrangement (“Early Booking”). If this option is available, it will be clearly indicated alongside the relevant Travel Product in your search results. An Early Booking requires an initial partial payment at the time of reservation, with the remaining balance due at a specified later date, as outlined in your confirmation email and on the Tripwise Website. The outstanding balance will be automatically deducted from your designated Payment Method on the due date. You are responsible for ensuring that your Payment Method remains valid and has sufficient funds at the time of the scheduled payment. If the transaction cannot be processed for any reason, you will need to provide an alternative valid Payment Method. Failure to complete payment in time may result in the cancellation of your Booking.

7.9 If your selected Travel Product becomes unavailable, we may offer you an alternative option. Your Payment Method will only be charged if you accept the new Travel Product and the revised pricing. Should you choose not to accept the alternative option, no charge will be made to your Payment Method by Tripwise.

7.10 All personal information submitted during the payment process is protected using our secure payment gateway using encryption technology to safeguard your data. This advanced encryption ensures that all transactions, as well as any personal information transmitted through our Website, remain secure and confidential.

7.11 Transaction fee charges would not be refunded/ reversed under any circumstances for any refund/ reversal /chargeback and any other reasons.

7.12 Transaction fees charged would be borne by cardholder for any payment.

8. Changes, Cancellations, and Refunds

8.1 The cancellation policy applicable to the Travel Products will be displayed before you finalize your online Booking. It is essential that you carefully review this policy, as cancellation terms may differ depending on the Service Provider and the specific Travel Product being booked. Each Service Provider has its own set of rules regarding cancellations, and by proceeding with your Booking, you acknowledge that you understand and accept the applicable terms.

8.2 Voluntary changes to your Booking may be permitted up to 48 hours prior to your scheduled departure. However, any modifications or cancellations initiated by you may incur fees imposed by the respective Service Provider. In addition to the Service Provider’s charges, we may apply processing fees to handle your request. If your Booking includes multiple passengers, any changes made must apply to all travellers included in the Booking. If you wish to modify the Booking for only some travellers, you acknowledge that it is your responsibility to coordinate directly with the Carrier or other relevant Service Providers. When requesting a voluntary cancellation, please note that we cannot provide an immediate calculation of the refund amount you may be entitled to, as this depends on the terms set by the Service Provider. Some Bookings are strictly non-refundable, and in such cases, no refund can be issued. Additionally, if you fail to arrive on your scheduled Booking date, decide to depart early, or do not show up for your Booking, Tripwise will not be responsible for issuing a refund. Furthermore, if changes or cancellations are made after a certain deadline or fall under specific exceptions, a cancellation fee may still apply, in accordance with the policies of the Service Provider.

8.3 If your Booking is altered or cancelled by the Service Provider or any associated third party, we will make every reasonable effort to inform you as soon as possible. However, we are not responsible for any disruptions, inconveniences, or additional expenses caused by such cancellations or modifications made by third parties.

8.4 If you need to modify the dates of your Booking with an Accommodation Provider, you can log in to your Tripwise Account and use the “Change my dates” feature. For any other modifications related to Accommodation Providers, or to change Bookings involving Carriers or Activity Providers, you must contact us directly. Failure to process amendments through Tripwise may result in a 100% charge for the original Booking.

8.5 In the rare event that a confirmed Booking with an Accommodation Provider becomes unavailable before your check-in date, Tripwise will issue a full refund. If we receive prior notice of the unavailability, we will inform you via email. However, if you arrive at your accommodation and discover that the property is closed, overbooked, or undergoing maintenance that prevents your stay, you agree that the Accommodation Provider is solely responsible for arranging alternative accommodations of comparable quality or offering a refund. You acknowledge that Tripwise is not liable for such situations and will not provide a refund or alternative lodging.

8.6 If you qualify for a refund, either in full or in part, the refund will only be processed after we receive the cleared funds from the Service Provider. Once we have received the necessary funds, we will issue the refund to your credit card, debit card, or Tripwise Wallet within seven (7) working days from the date we receive your cancellation or modification request.

9. Acceptable Use

9.1 By accessing and using the Website, you agree and confirm that you will:

  • Utilize the Website strictly for personal and non-commercial purposes, acknowledging that any other use is strictly prohibited.
  • Refrain from collecting, extracting, reproducing, or displaying any material from the Website, including Travel Product pricing and availability, on another website or digital platform using automated tools such as robots, spiders, or “screen scraping” software.
  • Not use the Website to facilitate or distribute Tripwise Bookings, pricing details, or other travel-related information to third parties beyond your personal, non-commercial use.
  • Ensure that your use of the Website complies with all applicable laws and does not violate any terms outlined in this agreement.
  • Respect individual privacy rights and refrain from uploading, sharing, or distributing personal or private information of others without their explicit consent.
  • Not impersonate any individual or entity while using the Website.
  • Avoid using the Website for defamatory, libellous, or malicious activities against Tripwise, its employees, or any other individual.
  • Not introduce or transmit any malicious software, such as viruses, Trojan horses, worms, or other items designed to disrupt, damage, or compromise the security of our systems or those of other users.
  • Avoid posting or transmitting any unauthorized content that is, in our opinion, offensive, defamatory, obscene, threatening, racist, pornographic, or otherwise inappropriate. This includes content that could damage our systems or infringe upon the security of third-party networks.
  • Not interfere with, manipulate, or make unauthorized modifications to the Website, including attempting to delete, alter, or tamper with data without permission.
  • Ensure that your use of the Website does not violate any intellectual property rights, obligations of confidentiality, or any applicable laws.
  • Not attempt to gain unauthorized access to the Website, other user accounts, computer networks, or systems linked to the Website through hacking, password mining, or other unlawful means.

9.2 To complete a Booking on the Website, you must be at least 18 years old or meet the minimum legal age requirement in your jurisdiction if it is higher than 18. By using the Website, you confirm that you possess the necessary legal authority to enter into agreements under these Terms. Tripwise is not liable for any expenses incurred due to minors using the Services, including any Bookings made by individuals who do not meet the minimum age requirement.

9.3 Unless explicitly stated otherwise, all intellectual property rights—including but not limited to copyrights, trademarks, designs, patents, and other proprietary materials—found on the Website belong to us or are licensed to us by third-party providers. This includes all text, images, graphics, logos, software, and other content made available on the Website (“Content”). By using the Website, you acknowledge that you do not obtain any ownership rights to the Content or the Website itself. However, we grant you a limited, non-exclusive license to access and view the Content, strictly in accordance with these Terms. Any reproduction, redistribution, or unauthorized use of the Website or its Content is strictly prohibited and may lead to legal penalties. Additionally, you must not copy, distribute, or publish any Website Content on another server or platform without explicit permission. Any unauthorized use beyond what is legally permitted is expressly prohibited.

9.4 We retain the sole discretion to determine whether your use of the Website violates these Terms. If a breach occurs, we reserve the right to take appropriate action, which may include restricting your access to the Website, initiating legal proceedings, or reporting the violation to law enforcement authorities as deemed necessary.

9.5 The Website may contain external links to third-party websites for your convenience. However, we do not guarantee that these links will remain active or updated. We assume no responsibility for any damages, disruptions, or technical issues that may arise from using third-party websites linked to our platform. It is your responsibility to ensure that any content or files you access from the Website are free from viruses, malware, or other harmful elements.

9.6 If we permit users to post content or comments on the Website, we reserve the right to remove any material at our sole discretion and without prior notice.

9.7 By using the Website or engaging with us through email, phone, or other communication channels, you consent to receiving communications from us. These communications may include emails, phone calls, messages via messaging applications, or in-app notifications. If you wish to unsubscribe from marketing emails, you can do so by clicking the “Unsubscribe” link at the bottom of any marketing email or by contacting us directly. However, opting out of marketing emails will not affect non-promotional communications related to your Bookings, which you will continue to receive.

9.8 If you do not agree to these Terms, you must refrain from using the Website.

10. Agency

10.1 The Services provided by us operate under an agency model, meaning we act as an intermediary authorized to sell Travel Products on behalf of multiple Service Providers. Our responsibility is to facilitate the Booking process on your behalf and establish contractual agreements between you and the respective Service Providers. Any Travel Product you purchase through our Services under these Terms is supplied by third-party Service Providers, and not by Tripwise itself.

10.2 While we carefully select reputable third-party Service Providers to offer Travel Products, we have no direct control over the delivery, quality, or execution of these products and, therefore, hold no liability in relation to their provision. Any arrangements made through us are subject to the terms and conditions imposed by the Service Provider delivering the Travel Product. You may request a copy of the Service Provider’s terms at any time. If issues arise regarding the fulfilment of your Travel Product, or if the Service Provider is unable to provide the agreed-upon service, you acknowledge that, unless the issue is caused directly by our error, your legal recourse is with the respective Service Provider, not with Tripwise.

11. Representation

11.1 We assure you that our Services will:

  • (a) Be delivered with appropriate care, professionalism, and expertise.
  • (b) Be suitable for their intended purpose.
  • (c) Be reasonably expected to achieve the intended results.
  • (d) Be provided within a reasonable timeframe.

11.2 EXCEPT AS OUTLINED ABOVE, ALL OTHER EXPRESS OR IMPLIED WARRANTIES, CONDITIONS, OR REPRESENTATIONS—INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT—ARE DISCLAIMED TO THE EXTENT PERMITTED BY LAW. WE MAKE NO GUARANTEES REGARDING THE RELIABILITY, AVAILABILITY, OR SAFETY OF THE SERVICES WE PROVIDE, EXCEPT WHERE SUCH WARRANTIES CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

12. Limitation of Liability

12.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIPWISE AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR ASSOCIATED ENTITIES WILL NOT BE HELD LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR SPECIAL DAMAGES. THIS INCLUDES, BUT IS NOT LIMITED TO, DELAYS, INCONVENIENCES, ADDITIONAL EXPENSES, OR LOSSES RESULTING FROM:

  • Your use or inability to use our Services.
  • Errors or failures of third-party Service Providers.
  • Uncontrollable external events, including force majeure or extraordinary circumstances that could not have been prevented despite reasonable diligence.

12.2 IF, FOR ANY REASON, TRIPWISE IS FOUND TO BE LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM YOUR USE OF OUR SERVICES, OUR TOTAL LIABILITY WILL BE LIMITED TO:

  • (a) Reissuing your Booking (or rectifying any defect in your Booking), or
  • (b) Offering a refund or credit equivalent to the total amount paid for your Booking, calculated at the pro-rata contract rate.

12.3 IF THESE LIMITATIONS OF LIABILITY ARE UNENFORCEABLE UNDER YOUR LOCAL JURISDICTION, THE LIMITATIONS, EXCLUSIONS, AND DISCLAIMERS SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We shall not be liable for any damages, injuries, or losses that may arise from travel to any location listed on our Website. Tripwise is not responsible for any losses resulting from your failure to obtain valid travel documents, including but not limited to passports, visas, or health-related certifications. It is your sole responsibility to ensure you meet the necessary entry and exit requirements for your journey.

13.5 Taxation Policies

The tax charges applied to Travel Product purchases made through Tripwise represent the recovery of all applicable taxes that Tripwise remits to its suppliers. Tax obligations and rates differ based on location and are subject to change. The actual tax amount paid to a supplier may vary from the tax recovery charge applied at the time of Booking. You acknowledge that Tripwise is not obligated to provide itemized tax breakdowns or refunds of tax charges.

13.6 Currency Exchange Rates

The currency exchange rates displayed on the Website are for informational purposes only and are not guaranteed to be accurate at the time of your Booking. Currency values fluctuate, and the actual rate applied to your transaction may differ from those displayed on the Website.

13.7 Accuracy of Website Information

The Website may contain inadvertent inaccuracies, outdated details, or typographical errors, including but not limited to pricing errors, product descriptions, and Travel Product details. The Travel Products, services, software, and information published on the Website may contain occasional inaccuracies, including but not limited to incorrect descriptions, misleading photographs, outdated amenities, and unavailable facilities. Tripwise and its suppliers shall not be held responsible for any errors in the presentation of Travel Products.

13.9 Travel Product Ratings

Any ratings of Travel Products displayed on the Website are intended solely as general guidelines. These ratings are subject to change and may not always reflect the most up-to-date conditions. Tripwise does not warrant or guarantee the accuracy of any rating information, and users are encouraged to independently assess the suitability of a Travel Product based on personal preferences.

13.10 Right to Refuse Service

We reserve the right, at our sole discretion, to reject customers or cancel Bookings without justification. This includes, but is not limited to, cases where a Service Provider requests cancellation, instances of suspected fraud, legal restrictions, economic sanctions, credit card payment issues, inaccurate user information, trade embargoes, or past violations of our Terms. If a Booking is cancelled and payment has already been received, Tripwise will refund the full amount paid. Additionally, we reserve the right to blacklist users from the Website on either a temporary or permanent basis. Any user who has been blacklisted must not attempt to access the Website under a different identity. In rare instances, we may cancel a Booking due to an “obvious error.” An “obvious error” refers to a mistake on the Website (e.g., incorrect pricing) that a reasonable person would recognize as an unintentional mistake. In such cases, the Booking will be cancelled, and any payments made will be refunded. The decision to cancel a Booking due to an obvious error is solely at the discretion of Tripwise.

13.11 Compliance with Law Enforcement

These Terms and Conditions are subject to all applicable legal and regulatory requirements. Tripwise reserves the right to comply with law enforcement agencies, governmental authorities, and legal proceedings regarding any activity on the Website. To the fullest extent permitted by law, any claim or legal action related to your access or use of our Services must be filed within two (2) years from the date on which the claim arises. Any claims filed beyond this period will be permanently waived.

13.12 Entire Agreement

In such cases, we are not liable for any legal responsibilities arising from delays, cancellations, or service disruptions.

13.17 Governing Law

These Terms, along with all contractual relationships established under them, shall be governed by and interpreted in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the jurisdiction of the courts in India.
